PRIVACY NOTICE

The Purpose of This Notice

Title V of the Gramm-Leach-Bliley Act (GLBA) and the laws of the State of California generally prohibit us from sharing nonpublic personal information about you with a third party unless we provide you with this notice of our privacy policies and practices describing the type of information that we collect about you and the categories of persons or entities to whom that information may be disclosed. In compliance with the GLBA and California Law, we are providing you with this document, which notifies you of the privacy policies and practices of Motor Vehicle Software Corporation Insurance Services, LLC d/b/a Vitu Insurance Services (“Vitu Insurance”). We reserve the right to change this privacy policy at any time.

Our Privacy Policies and Practices

  1. Information We Collect:

    1. Categories of Information Collected and Sources from Which We Collect It.

      We may collect nonpublic personal information about you from the following sources and unless stated otherwise in an amended Privacy Policy notice, no additional information will be collected about you:

      1. Information that you provide us on applications and other forms, including your driver’s license.
      2. Information about your transactions with us from the insurance companies we contact to underwrite your insurance.
      3. Information we receive from the Department of Motor Vehicles or other consumer reporting agencies.
      4. Information we obtain from third party data sources about other potential drivers and vehicles in your household.
    2. Persons from Whom Information is Collected

      We may collect nonpublic personal information from individuals other than those proposed for coverage.

  2. Information We May Disclose to Third Parties:

    In the course of our general business practices, we may disclose the nonpublic personal information that we collect (as described above) about you or others without your permission to the following types of institutions for the reasons described below:

    1. To a third party if the disclosure will enable that party to perform a business, professional or insurance function for us.
    2. To a Vitu Insurance affiliate, which includes a provider of electronic vehicle registration services, in order to market its own products and services. Our affiliates will not share the information with non-affiliated third parties.
    3. To an insurance institution, agent, or credit reporting agency in order to detect or prevent criminal activity, fraud or misrepresentation in connection with an insurance transaction.
    4. To an insurance institution, agent, or credit reporting agency for either this agency or the entity to whom we disclose the information to perform a function in connection with an insurance transaction involving you.
    5. To the Department of Insurance or other insurance regulatory authority, law enforcement, or other governmental authority if required by law in order to protect our interests in preventing or prosecuting fraud, or if we believe that you have conducted illegal activities.
    6. To an automobile dealership in order to provide proof of your insurance coverage for a prospective motor vehicle purchase or lease transaction.
    7. Pursuant to a lawful subpoena.
    8. Unless it is specifically stated otherwise in an amended Privacy Policy Notice, or pursuant to Section 6, below, we will not otherwise share your nonpublic personal information.

  3. Your Right to Access and Amend Your Personal Information:

    You have the rights to request access to the personal information that we record about you. Your rights include the right to know the source of the information and the identity of the persons, institutions, and/or types of institutions to whom we have disclosed such information within 2 years prior to your request. Your rights include the right to view such information and copy it in person, or request that a copy of it be sent to you electronically or mail [CT1] (for which we may charge you a reasonable fee to cover our costs). Your rights also include the right to request corrections, amendments or deletions of any information in our possession, and, if we disagree with your request, to add your views to our records. Please be aware that we do not control the personal information about you from other third parties such as consumer reporting agencies or Department of Motor Vehicles. You will need to contact these third parties directly to correct your personal information. We will provide you with the name and address of these third parties upon request. In order to obtain your information, or request a correction or amendment to your information you must submit a written request to us including your name, address and telephone number, at:

    For information requests, your request should also describe the recorded information to which you would like access, and state whether you would like access in person or a copy of the information sent to you by mail. Upon receipt of your request, we will contact you within 30 business days to arrange providing you with access in person or the copies that you have requested.
    For requests to correct, amend, or delete any of your information, your request should also describe the specific information in dispute, and the identity of document or record that contains the disputed information. Upon receipt of your request, we will contact you within 30 business days to notify you either that we have made the correction, amendment or deletion, or that we refuse to do so and the reasons for the refusal, which you will have any opportunity to challenge.

  4. Our Practices Regarding Information Confidentiality and Security:

    We restrict access to nonpublic personal information about you to employees who need to know that information in order to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

  5. Reservation of The Rights to Disclose Information in Unforeseen Circumstances:

    In connection with the potential sale or transfer of its interests, Vitu Insurance Services reserves the right to sell or transfer your information (including but not limited to your name, address, date of birth, sex, driver’s license, and other information that you provide through other communications) to a third-party entity that (1) concentrates its business in a similar practice, product or service: (2) agrees to be Vitu Insurance's successor in interest with regard to the maintenance and protection of the information collected: and (3) agrees to the obligations of this privacy statement.

  6. Opt-Out Form Available Upon Request

    After reading this Notice, you understand that Vitu Insurance respects your privacy and takes its responsibility to protect your information seriously. You have the right to prohibit the sharing of your nonpublic personal information with some third parties under certain circumstances, such as a Vitu Insurance affiliate for purposes of marketing their products and services to you, except as otherwise permitted by law. If you choose to exercise this right, you must do so using an Opt-Out form, which you can request through any of the following methods:

  7. Vitu Insurance Affiliates

    Vitu Insurance affiliates are companies related by common ownership or control, directly or indirectly, with Vitu Insurance. They can be financial and nonfinancial companies. Our Affiliated Companies include Motor Vehicle Software Corporation, Inc., a provider of services relating to electronic vehicle registration and other government- related transactions. Please note that Vitu Insurance Services affiliates transact business through various DBAs and may change from time to time. The list of Vitu Insurance affiliates above is not intended to be complete.

Your California Privacy Rights and Choices

The California Consumer Privacy Act of 2018 (CCPA) provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that Vitu Insurance disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we disclosed your personal information for a business purpose, the categories of personal information, if any, that we disclosed to third parties for a business or commercial purpose in the preceding 12 months.

Deletion Request Rights

You have the right to request that Vitu Insurance delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by one of the following methods:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Right Opt-Out of the Sale of Personal Information

Vitu Insurance does not engage in the sale of personal information.

Right to Non-Discrimination for the Exercise of Consumer’s Privacy Rights

Vitu Insurance will not discriminate against you for exercising any of your CCPA rights. Unless otherwise permitted by the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
